Terms & Conditions

These Terms of Service ("Terms") govern your access to and use of the Services provided by AdOne ("Company", "we", "us", "our") to you ("Client", "Customer", "you", "your"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must cease using our Services immediately.

1. Definitions

1.1 Account: The user profile created at https://adone.io to access the Services.

1.2 Brand: Your trademark and visual identity submitted for use with the Services.

1.3 Credits: Virtual credits enabling you to generate and download content.

1.4 Content: Marketing materials (texts, images, emails, ads) generated through the Services.

1.5 Services: AdOne's AI-powered content creation platform enabling you to generate Content.

1.6 Subscription: Your enrollment and agreement to pay ongoing fees to access the Services.

1.7 Subscription Plan: The specific plan level (Starter, Professional, Scale, etc.) you subscribe to.

2. Access and Use

2.1 Grant of Rights: We grant you a non-exclusive, non-transferable right to use the Services during your Subscription period solely for internal business purposes.

2.2 Restrictions: You must not copy, reverse engineer, or resell the Services; use them for illegal purposes; upload infringing content; attempt unauthorized access; submit harmful content; or sublicense the Services.

2.3 Account Security: You are responsible for safeguarding your account credentials and all account activity.

3. Services

3.1 Services are deemed delivered upon providing access credentials, regardless of actual usage.

3.2 AI-generated content may not be unique; similar outputs may be generated for other users.

3.3 You may cancel your account at any time by emailing support@adone.io.

4. Subscription and Payment

4.1 Fees: Current pricing appears at https://adone.io/pricing. Fees may change with 30 days' notice.

4.2 Billing Cycles: Monthly, quarterly, or annual plans are billed in advance and automatically renew unless cancelled.

4.3 Cancellation: Email support@adone.io to cancel. Cancellation takes effect at the end of the billing period, and access remains until that period ends. No partial refunds unless Section 4.6 applies.

4.4 Payment Methods: We accept major credit cards. You must provide accurate and current billing information.

4.5 Credits: Unused credits do not roll over between billing periods.

4.6 Refund Policy: Full refund within 14 days if you have not created more than 20 content pieces (excluding onboarding). Requests must be sent to support@adone.io. No refunds after 14 days or after creating more than 20 ads post-onboarding.

5. Intellectual Property

5.1 AdOne retains ownership of all software, algorithms, and platform elements.

5.2 You retain rights to your brand assets and input materials; you grant us a license to use them solely to provide the Services.

5.3 You own the generated content, subject to Section 3.2.

6. Disclaimers

6.1 Services are provided "as is" without warranties of any kind.

6.2 We do not guarantee uninterrupted, error-free operation or specific outcomes.

6.3 Our total liability shall not exceed fees paid by you in the six months preceding any claim.

7. Data Privacy

7.1 We process your data solely to provide the Services, as detailed in our Privacy Policy.

7.2 We implement industry-standard security measures to protect your data.

7.3 We comply with applicable data protection laws, including GDPR.

8. Termination

8.1 You may terminate anytime per Section 4.3.

8.2 We may suspend or terminate your access for breach of the Terms, non-payment, illegal or harmful use, or violation of third-party rights.

9. Confidentiality

Each party agrees to maintain the confidentiality of the other's confidential information using reasonable care and not disclose it to third parties.

10. General Provisions

10.1 These Terms constitute the entire agreement between the parties.

10.2 We may modify the Terms with 30 days' notice; continued use constitutes acceptance.

10.3 These Terms are governed by the laws of Lithuania without regard to conflict-of-law principles.

10.4 If any provision is unenforceable, the remaining provisions remain in effect.

You may not assign these Terms without our written consent.

10.6 Neither party is liable for delays caused by force majeure events beyond reasonable control.
